1 Area of validity, customers
1.1 These Terms & Conditions are valid on all business connections between MAJA WALESKA Maja Mazurkiewicz, Ackerstr. 84, 40233 Düsseldorf (hereinafter “the Seller”) and customers (hereinafter “the Client”).
1.2 The Seller shall offer products for sale and shall perform his e-commerce activities exclusively in relation to his final end-users, who are adults and “consumers”, or rather, natural persons, who do not act in relation to any commercial, entrepreneurial, artisan or professional activities (hereinafter “the Client”). The Seller shall be entitled not to process any orders from individuals, other than the “consumer”, and/or minors or orders that are not in compliance with his own commercial policy.
1.3 The contract language on the formation of the purchase contract over this website is English.
2 Offer, contract formation
2.1 The website www.majawaleska.com (hereinafter “website”) provides a non-committal offer for the Client to send an offer to close a purchase contract over the goods presented on the website. It does not provide a legally binding contract offer by the Seller. The purchase contract will be closed if the Seller explicitly accepts the offer provided by the Client.
2.2 When the Client completes an order over the website, the Seller will confirm the receipt of the order immediately. The confirmation over the receipt of the order does not constitute the acceptance of the offer to close the purchase contract. It solely informs the Client, that his order and his offer to close a purchase contract have been received.
2.3 When the Client completes an order over the website, the Client provides an offer to close a purchase contract with the Seller. The sending of the offer by the Client obligates the Client to the payment of the purchase price for the ordered goods. The acceptance of the offer and the closing of the purchase contract with the Seller follows through explicit declaration of acceptance over e-mail by the Seller or through the shipment of the ordered goods to the Client.
2.4 The Seller shall be entitled not to accept an order in case of misspelling, miscalculation or other errors found on the website afterwards or if the products are unavailable. In these instances, the Seller shall promptly undertake and, in any case, within fourteen (14) days, starting from the date on which the order was sent to the Seller, to inform the Client, by e-mail, that the purchase contract has not been closed and that the Seller shall not process the order. In the case in which the Client has already paid for the ordered goods, the Seller shall undertake to refund all payments received.
3 Characteristics of products
3.1 The products are exclusively “MAJA WALESKA” brand products.
3.2 The essential characteristics of the products are described on each product description on the website.
3.3 The products come with an identification tag, which constitutes an integral part of the product.
4 Prices, payment
4.1 The product prices displayed on the website are calculated in Euro (€) and do not include delivery charges, which are displayed separately before the order is placed.
4.2 The product prices may be subject to variations. The Seller reserves the right to change the product prices at any time and without prior notice, but such changes will not apply to any orders already placed. The Client shall check the final sales price prior to placing the order.
4.3 The Client may pay for purchases by PayPal or Credit Card.
4.4 Payment by PayPal
With selection of the payment option „PayPal“ and after placing the order, the Client will be redirected to the PayPal website. After confirmation of the order with PayPal, the Client will be redirected to the website’s confirmation page. The debit of the Client’s account and shipping of the order will take place after verification of the Client’s data, receipt of authorization to debit the Client’s account and confirmation of the product’s availability by the Seller.
4.5 Payment by Credit Card
With selection of the payment option „Credit Card“, the Client may pay for purchases with cards of the CB-network, Visa, Mastercard, American Express and Apple Pay. The debit of the Client’s account and shipping of the order will take place after verification of the Client’s data, receipt of authorization to debit the Client’s account and confirmation of the product’s availability by the Seller.
4.6 The Client consents to receiving invoices and credits solely in electronic form.
4.7 The Client will receive a written confirmation of the price paid for each product and the delivery costs no later than at the time of delivery.
4.8 The products sold might be subject to Customs Clearance costs, such as importation taxes and/or duties, which are demanded on the product’s arrival in the country of delivery. The Customs Clearance costs cannot be envisaged by the Seller in advance, and they shall, in any case, be fully borne by the Client. The Client should contact his customs office for further information. In the event that the charges and / or taxes are not paid by the Client and the shipment is refused or abandoned as a result, the delivery expenses and the customs taxes will be deducted from the total amount of the order and only the difference will be reimbursed.
5 Shipment, delivery
5.1 Delivery time is displayed on every product page, in the shopping bag and in the order summary appearing on the last page of the online shop ordering process.
5.2 Delivery time on the website is estimated from the time of dispatch of the order, not from time of placement.
5.3 Delivery time on the website refers exclusively to business days, explicitly excluding public holidays.
5.4 The products ordered over the website are sent to the delivery address provided by the Client upon placing the order. Restricted addresses for delivery are P.O. boxes, hotels and freight forwarders.
6 Statutory right of withdrawal
Information regarding the right of withdrawal
The Client has the right to withdraw from this contract within fourteen (14) days without the need of providing any reason. The period of withdrawal is fourteen (14) days from the day on which the Client, or a third party designated by the Client, who is not the carrier, took possession of the last item of the ordered goods.
In order to exercise his right of withdrawal the Client must notify us MAJA WALESKA Maja Mazurkiewicz, Ackerstr. 84, 40233 Düsseldorf / Germany, e-mail: email@example.com of his decision to withdraw from contract by sending an unequivocal declaration (e.g. a letter sent by post or an e-mail). If the Client wishes, he may use the attached withdrawal form, however this is not obligatory. The Client will be deemed to have complied with the withdrawal period if he sends his notice of withdrawal before such period expires.
Consequences of withdrawal
If the Client withdraws from this contract, we are required to refund all payments we received from the Client, including delivery costs (except any additional costs incurred as a result of the Client choosing a delivery method other than the lowest-cost standard delivery offered by us), without undue delay and at least within fourteen (14) days from the day on which we received the Client’s notice of withdrawal from this contract. Refunds will be processed using the same method of payment which the Client used for the original transaction, unless expressly agreed otherwise with the Client. We will not charge the Client any fees for the refund.
We may hold off completing the Client’s refund until we have received the goods back, or the Client has supplied us with proof that he has returned the goods, whichever occurs earlier. The Client is obliged to return or hand over all goods to us without undue delay, but at least within fourteen (14) days from the day on which he notified us on his withdrawal from this contract. The above requirement is deemed satisfied if the Client returns the goods before the expiry of the 14-day period. The Client is required to pay the return shipping costs.
The Client is only obliged to cover any depreciation in the value of goods if the depreciation is attributable to the Client’s improper handling of the goods when examining its condition, properties and function.

Exclusion of the statutory right of withdrawal
The right of withdrawal expires prematurely for contracts subject to sealed goods which have been unsealed after delivery and which are not suitable for return due to hygienic reasons.

8 Statutory liability for defects and further information
8.1 The relevant statutory provisions govern the Seller’s liability for defects.
8.2 These Terms & Conditions can be viewed on www.majawaleska.com. The Client may also print or save this document by selecting the usual commands in his web browser (usually “File” –> “Save as”).
8.3 The Client may also save these Terms & Conditions and his order details by saving the order summary appearing on the last page of the online shop ordering process (as described in 8.2).
8.4 Upon completion of an order, the order summary and the Terms & Conditions will be emailed to the Client.
8.5 Link to the platform of the European Commission according to Regulation on consumer ODR. We are neither obligated nor willing to participate in a dispute settlement procedure at a consumer arbitration board.
